Title Commitment Effective Date

What is an effective date on a title commitment and what does it represent?

The title commitment is the title company’s promise to issue a title insurance policy to the property after closing. The commitment is created from a title search conducted by searching through public records to determine if the property is free and clear, if any restrictions or allowances are imposed on the property, or if any liens exist on the property that require payoff at closing.

A key part of the title commitment is the effective date, which is the last date through which the available searches from the county on the property are covered. Given that this effective date is dependent on title search, when a commitment’s effective date needs to be updated, it means that updated searches on the property must come in and be reviewed to make sure nothing new is affecting the property.
